1. Access to Website

2. Order Requests to Worldwide

2.1 Worldwide reserve the right to refuse to carry out any order made through the Website or otherwise which Worldwide or its affiliates, at their sole discretion, deem to contain content that is pornographic, obscene, immoral, depraved, potentially illegal, or that potentially exposes Worldwide or our affiliates to liability or prejudice of any type.

2.2 You agree that:

(a) you will indemnify Worldwide from and against all actions, claims, demands, losses, damages, proceedings, compensation, costs, charges and expenses for which any Worldwide may be or becomes liable in respect to the material you provide to Worldwide for procuring its services;

(b) local call charges apply for the 1300 phone service. Normal charges may apply for calls from mobile phones;

(c) any estimates, quotes and orders generated by Worldwide are provided in accordance with its terms and conditions as listed on the Website; and

(d) all prices stated on this Website are in Australian Dollars.

3. Third Party Websites

3.1 The Website may link or refer to third party websites that are not owned or managed by Worldwide (such as  websites of corporate affiliates). Worldwide makes no representation or warranties as to the third party websites and accepts no liability whatsoever in respect to the content of the third party websites. Accessing third party websites is at your own risk.

4. Intellectual Property

4.1 Unless identified otherwise, all intellectual property contained in or downloadable from the Website is owned by or licensed to Worldwide (“Intellectual Property”).

4.2 The Intellectual Property includes, but is not limited to, all audio, video, photos, designs, layout, texts, images, techniques, logos and trade marks as displayed on the Website.

4.3 Except for the purposes of viewing the Website, the Intellectual Property may not be reproduced, transmitted, adapted, distributed, sold, licensed, modified, published or stored by you, unless with the copyright holder’s prior written consent.

4.4 Worldwide consents to:

(a) the user making such temporary copies in a single computer’s RAM and hard drive cache as are necessary to browse the Website;

(b) the user making one permanent printout of each page of the Website (unmodified in form, with a copy of these Terms of Use attached) to be used by the user for personal and non- commercial uses which do not harm the reputation of the Website owner or its affiliates; and

(c) certain software downloads or other content being used for limited purposes if expressly stated in a license agreement on this Website which makes express reference to the software or content.

4.5 Where Worldwide has made use of another person’s Intellectual Property, Worldwide has done so with the owner’s consent. You acknowledge that such Intellectual Property is also protected by laws relating to copyright, trade marks, designs and other intellectual property and must not be imitated in whole or in part on other websites.

4.6 Any software downloaded from this website, including but not limited to images, documents, files, and accompanying data is licensed to you, and remains the property of its respective trademark and/or copyright owner. No title or intellectual property rights are transferred to you.

4.7 You understand that the owner of any trademark, service mark, logo, or copyrighted material has the exclusive right to use and reproduce such material. You therefore cannot reproduce any unlicensed trademarks, service marks, logos, or copyrighted material onto printed materials and merchandise via the service offered through this Website, especially the Online Marketing Platform.

5. User Submissions on Website and Worldwide Social Media Sites

5.3 Once any User Submissions are submitted to the Website or through any other Social Media managed by Worldwide, the User Submissions become the property of Worldwide unless otherwise determined by Worldwide at its sole discretion.

5.4 In respect to the User Submissions, you agree and acknowledge that:

(c) you indemnify Worldwide from and against all actions, claims, demands, losses, damages, proceedings, compensation, costs, charges and expenses for which any Worldwide may be or becomes liable in respect to the User Submissions.

5.5 Worldwide does not guarantee any confidentiality with respect to the User Submissions.

5.6 Worldwide may publish your name on the User Submissions.

5.7 Worldwide does not endorse any User Submissions or any opinion, recommendation, or advice expressed therein, and Worldwide expressly disclaims any and all liability in connection with User Submissions and the hosting, sharing and/or publishing of the User Submissions on the Website or on Worldwide’s Social Media.

5.8 Worldwide reserves its right to remove or block User Submissions (in whole or in part) or particular content in the User Submissions in accordance with the Social Media Rules and otherwise at its sole discretion for any reason whatsoever and without notice.

In order to maintain customer satisfaction, Worldwide will not materially change the features and specifications of a product or services which has been ordered once the order has been accepted by Worldwide.

(b) On occasion, products and services offered by Worldwide may be incorrectly priced on the Website or incorrectly quoted due to error. If Worldwide has made a mistake and a product’s correct price is higher than the price on the Website or the quoted price, Worldwide shall endeavor to contact you before shipping to request whether you want to buy the product at the correct price or cancel your order. If a product’s correct price is lower than the stated price on the Website, Worldwide shall charge the lower amount and send you the product ordered. Where a higher (incorrect) price has been charged, Worldwide agree to refund the price difference and send you the product ordered. Worldwide shall immediately endeavor to fix any incorrect pricing.

10.2 Any claim or dispute between you and Worldwide that arises in whole or in part from the Website shall be decided exclusively by a court of the competent jurisdiction located in Sydney, New South Wales.

10.3 The Terms of Use shall constitute the entire agreement between you and Worldwide concerning the Website.
