This website at www.worldwide.com.au is operated by Worldwide Online Printing Pty Ltd ACN 141 627 401, trading as Worldwide Franchisor, together with its related entities and participating Worldwide Franchisees, as applicable.

In these Terms and Conditions, Worldwide, we, us and our means Worldwide Online Printing Pty Ltd, its related entities and, where relevant, participating Worldwide centres. You and your means any person who accesses or uses this website, submits an enquiry, requests a quote, uploads artwork, places an order or otherwise interacts with us online.

Products and services may be supplied by Worldwide Online Printing Pty Ltd, a participating Worldwide centre, or another related entity within the Worldwide network, depending on the nature of the enquiry or transaction.

These Terms and Conditions apply to your use of this website, including our online forms, quote request tools, artwork upload functions, product and service information, online resources, related platforms and links to Worldwide social media pages.

Relationship with our Terms of Trade

These Terms and Conditions govern your use of the website and your online interactions with Worldwide. They do not replace our Terms of Trade, which apply to accepted quotes, orders and the supply of goods and services by Worldwide unless we agree otherwise in writing.

When you request a quote, approve a proof, place an order, upload artwork for production or instruct Worldwide to commence work, your order may also be governed by our Terms of Trade, any quote or estimate we provide, any applicable artwork requirements, and any other written terms accepted by you.

If there is any inconsistency between these website Terms and Conditions and the Terms of Trade in relation to an accepted order, the Terms of Trade will apply to the extent of that inconsistency.

Changes to these Terms and Conditions

We may update these Terms and Conditions from time to time by publishing an updated version on this website. The updated version applies from the date it is published.

Where you have already accepted a quote or placed an order, changes to these website Terms and Conditions will not automatically change the terms of that accepted order unless the applicable order terms allow it or we agree otherwise with you in writing.

Using this website

Worldwide grants you a limited, non-exclusive and revocable right to access and use this website for lawful personal or business purposes, including browsing our products and services, finding a Worldwide centre, requesting a quote, uploading artwork, reading resources or contacting us.

You must not use this website in a way that is unlawful, harmful, misleading, fraudulent, disruptive or inconsistent with these Terms and Conditions. You must not interfere with the security or operation of the website, introduce viruses or malicious code, attempt to gain unauthorised access to systems, use automated scraping or harvesting tools without our written consent, or collect personal information from the website for unsolicited marketing or other unauthorised purposes.

Quotes, estimates and online enquiries

You may use this website to request a quote, find a centre, upload artwork, request information or contact Worldwide. Submitting an online form or enquiry does not create a binding order unless and until Worldwide accepts your order or confirms the relevant arrangement in writing.

Any quote, estimate or pricing information provided by Worldwide is subject to the scope, specifications, assumptions, artwork, quantities, materials, timing, delivery requirements and other details on which it is based. Unless stated otherwise in writing, prices are in Australian dollars and include GST where applicable.

Worldwide may decline to quote for or accept work where we reasonably consider that the requested work is outside our capability, capacity, ethical standards, legal obligations, supplier availability or commercial requirements.

Orders and production work

Orders for print, design, branded merchandise, signs, display materials, stickers, labels, technology solutions, marketing materials or related services are governed by the applicable quote, order confirmation, Terms of Trade and any other written terms accepted by you.

You are responsible for checking that all order details are correct before approving a quote, proof, artwork, online order or production instruction. This includes checking quantities, sizes, stock, colours, finishes, spelling, grammar, contact details, URLs, QR codes, barcodes, variable data, delivery details and any other content or production requirements.

Production timeframes are estimates unless we expressly agree otherwise in writing. Timeframes may be affected by artwork issues, proofing delays, customer approvals, supplier availability, freight, equipment, stock, third-party services, public holidays or events outside our reasonable control.

Artwork uploads and customer materials

If you upload or provide artwork, designs, logos, photographs, copy, data, fonts, files, brand assets, templates, mailing lists or other materials to Worldwide, you are responsible for ensuring that those materials are accurate, complete, suitable for the intended purpose and provided in the required format.

You warrant that you have all rights, licences, permissions and consents required for Worldwide to use, reproduce, modify, print, publish, store, transmit or otherwise handle those materials for the purpose of responding to your enquiry, preparing a quote, producing goods, providing services or completing your order.

Worldwide may refuse to print, produce, publish, distribute or otherwise handle material that we reasonably consider to be unlawful, offensive, discriminatory, defamatory, misleading, infringing, unsafe, inappropriate, contrary to our values or likely to expose Worldwide, a Worldwide centre, a supplier or another person to liability or reputational harm.

Proofs and approvals

Where Worldwide provides a proof, preview, sample, mock-up, test file, online proof or other approval item, you are responsible for reviewing it carefully before approval. Approval may be given in writing, online, by email or by any other method accepted by Worldwide.

Once you approve a proof or production item, Worldwide may proceed with production, ordering, printing, decoration, fulfilment, publication or dispatch in reliance on that approval. Subject to any rights that cannot be excluded by law, Worldwide is not responsible for errors, omissions or issues that appeared in an approved proof or arose from incorrect or incomplete information supplied by you.

Product images, colour and production tolerances

Images, samples and previews on this website are provided as guides only. Actual products may vary due to screen settings, production processes, paper and stock differences, ink, substrates, finishes, decoration methods, lighting, materials, supplier variations and manufacturing tolerances.

For print and production work, reasonable variations may occur in colour, trimming, folding, positioning, finishing, stock, packaging, quantities and other production characteristics. Any specific tolerance, quality or colour matching requirement should be discussed with Worldwide before an order is accepted.

Branded merchandise, third-party products and supplier availability

Some products and services promoted on this website rely on third-party suppliers, manufacturers, technology providers and service providers. Product availability, lead times, specifications and delivery schedules may be affected by factors outside our reasonable control.

We are not responsible for third-party delays, changes or availability issues except to the extent caused by our negligence or breach of an applicable agreement.

Any reviews, testimonials or feedback submitted to Worldwide may be used by Worldwide for service improvement and marketing purposes unless otherwise agreed.

Limitation of liability

To the maximum extent permitted by law, Worldwide is not liable for any indirect, consequential, special or incidental loss, loss of profit, loss of revenue, loss of business opportunity, loss of goodwill, loss of data, business interruption, production delay, third-party claim or reputational loss arising from your use of this website, reliance on website information, online enquiry, artwork upload, third-party link or website unavailability.

This clause does not limit any liability that cannot lawfully be excluded or limited.

Indemnity

You agree to indemnify Worldwide against losses, damages, claims, costs and expenses reasonably incurred by Worldwide arising from your breach of these Terms and Conditions, your unlawful use of the website, your infringement of another person’s rights, or materials, data or instructions you provide to Worldwide, except to the extent the loss is caused or contributed to by Worldwide’s negligence, wilful misconduct or breach of law.

Severability and waiver
